Terms of Sale

The present Standard Terms of Sale are applicable to Aéro Watch SA, the head office of which is located at 7, Rue de la Gare, 2350 Saignelégier, Switzerland and any individual visiting or making a purchase on the www.aerowatch.com website (hereafter referred to as "the Customer"). Internauts may refer to the Standard Terms of Sale on the website. The present Standard Terms of Sale are subject to modification, and the terms that apply are those in force on the site on the date when the order is placed. By placing an order, you acknowledge that you have read, understood and unreservedly accepted the present Standard Terms of Sale.



The present Standard Terms of Sale define the rights and obligations of either Party with regard to sales made via the Site affiliated websites. Said terms apply to individuals aged 18 or over with the legal capacity to enter into contracts. Aéro Watch SA could contact the Customer by telephone in order to verify the buyer's identity.
Aéro Watch SA reserves the right to refuse an order if it so chooses, particularly if a Customer fails to pay or is declared insolvent. Aéro Watch SA reserves the right to modify its prices and delivery costs at any time and to cancel any contracts that contain errors of naming, printing or calculation.
The data recorded by the payment system constitute irrefutable proof of financial transactions. When a Customer places an order, he or she will receive an e-mail confirming the details of the order and stating that the order will be shipped within the period indicated. This e-mail constitutes the sales contract between Aéro Watch SA and the Customer. If one or more items cannot be delivered within the times indicated for a reason outside the control of Aéro Watch SA, Aéro Watch SA shall inform the Customer by e-mail of the new availability date of the out-of-stock item(s).



When registering with the Site, the Customer must ensure that the required data supplied to Aéro Watch SA are accurate and complete. The Customer must choose a password when registering that will be used to access the Site. This password is strictly confidential, and must not be disclosed to any other party. The Customer takes full responsibility for the use of the password and for any orders placed using the password, even without the Customer's knowledge.



The prices given on the site are shown in American dollars ($). The prices shown on the Site are intended as a guide, and may be modified at any time. Only prices guaranteed by a written offer shall be valid until the offer expires.



Payments accepted by credit card (secure payment) or by bank transfer on our Swiss account. Any order placed on the www.aerowatch.com website may not under any circumstances be cancelled once the goods have been dispatched.



The products shall be delivered to the address indicated by the Customer on the purchase order form. The Customer is responsible for checking the state of the goods on delivery and for communicating any damage to the transporter on the delivery note and to Aéro Watch SA. Any problem relating to delivery (damage, missing item in relation to the delivery note, damaged parcel, broken products) shall be communicated to Aéro Watch SA on receipt. In the event of damage, the Customer shall in parallel contact the transporter the next working day after delivery at the latest. Any claim raised after this period shall be rejected. Claims to Aéro Watch SA may be made via the website under the "contact us" menu and by email to aero@aerowatch.com.
The Customer shall communicate to Aéro Watch SA on the day of delivery or at the latest the next working day after delivery any claim relating to delivery errors or non-compliant delivery in terms of the nature or quality of the products compared to the information on the purchase order.



Delivery times may vary depending on the models ordered. If the items are in stock at Aéro Watch SA on the date on which your purchase is validated, the delivery time is approximately 5-6 days (except in cases of force majeure, transport strikes etc.).
However, certain products (limited editions, watches containing gold, silver or platinum, watches that are very popular with the general public, etc.) may have a longer lead time depending on the calendar (Valentine's Day, Mothers' Day, Christmas etc.), delays in the supply of spare parts (watch faces, watch hands, cases etc.) to the parent companies or unfavourable purchase conditions in the international precious metal market. Lead times may thus vary from 10 days to 3 months.



All orders placed via the Site for delivery outside Switzerland may be subject to taxes and customs duties imposed when the package reaches its destination. These customs duties and taxes on product delivery are covered by Aéro Watch SA.



In the event of delivery of an article that does not comply with the order or has been damaged during transport, the Customer must consult our delivery policy (Article 5). In order to be accepted, the Customer must inform the Aéro Watch SA Customer Service of any return of goods. Delivery charges are payable by Aéro Watch SA, except where the returned product does not correspond to the original statement by the Customer in the return docket.
Under commercial law, no items that are as described on the Site and free of faults will be accepted for return by Aéro Watch SA following a change of mind on the part of the Customer.

It is possible to exchange a product within a period of 7 days from the date of receipt. If the new order corresponds to a greater value, the Customer shall include the additional sum with the exchange request (payment transfer). Conversely, if the exchange value is lower than the initial value, on receipt of the exchange request, the user shall receive a credit note equal to the price difference for a purchase to be made on the Site.



The items delivered shall remain the exclusive property of Aéro Watch SA until the Customer has fulfilled all obligations to Aéro Watch SA, and in particular until payment in full of the purchase price has been received.



Aéro Watch SA undertakes to take all the care customary in the profession in providing the service it offers to the Customer. However, Aéro Watch SA cannot be held liable in the event that contractual obligations are not complied with due to unforeseeable circumstances or a case of force majeure as defined by case law in the Swiss jurisdiction. Liability cannot be claimed in the event of delay caused by a manufacturer or supplier being out of stock. In addition, Aéro Watch SA cannot be held liable for insignificant differences between the products ordered and the photographs, text and descriptions presenting them on the Site. Aéro Watch SA takes all the steps in its power to provide services in compliance with the present Standard Terms of Sale. It is liable for any direct and foreseeable damage when the Site is being used.
Aéro Watch SA undertakes to replace any faulty products. If the faulty products can be replaced, no refunds will be available. The warranties applying to products purchased via the Site are identical to those applicable Jewellery and Watchmaking sector. If a product needs to be repaired after its guarantee has expired, the prices applied will be those in force. A prior quotation may be requested from the manufacturer at a cost of 50.00 USD, deductible from the repair bill if the repair is carried out.



Aéro Watch SA grants a limited licence to access and use the Site for personal use. The Customer is not authorised to download or modify any part of the Site without the express written permission of Aéro Watch SA. Said licence does not entitle the Customer to use the Site or its content (products listed, descriptions, prices, downloading or copying information on behalf of another trader, graphics, images, text, photographs etc.) for the purpose of sale or for any other commercial use. The site may not be reproduced, copied, sold or exploited for commercial purposes in whole or in part without the express written permission of Aéro Watch SA. The Customer shall not use any techniques to copy a trademark, logo or any other information (including images, text or layout) owned by Aéro Watch SA without express written permission.



Users of the Site may address to us criticisms, comments or any other content, provide suggestions, ideas questions or any other information insofar as the content is not illegal, obscene, abusive, threatening, slanderous, contrary to intellectual property rights, harmful to third parties and does not consist of contain any viruses or political message, commercial solicitation, mass mailings, chains or any other form of spam. It is prohibited to use a false e-mail address, to commit identity fraud relating to a person or an entity or to lie about the origin of the content. We reserve the right to remove or modify any content, at our own discretion.



The present Standard Terms of Sale are subject to Swiss law relating to international contracts for the sale of goods. All disputes about the commercial relationship between the Customer and Aéro Watch SA are subject to Swiss jurisdiction, and exclusively that of the "Tribunal Cantonal" of the Canton at Porrentruy, the head office of Aéro watch SA being located at Saignelégier (JU) Switzerland.
